that would certainly add weigh to that, though it's more a problem with him probably pretending that the payment was fraudulent and trying to rip it back out of my bank account than whether it was recieved or not.

I've phoned the police, they said to phone back if Ebay think there could be a case to answer and give me more into to pass on to the police.

I'm going to fight this as much as I can!

Mmm this is pretty simple, you can double f* the guy. If you can locate the IMEI of the phone have that reported to the police if the number is registered on a network they can trace who is using it if it becomes a Police matter.

Other wise block the phone as stolen...but either way dont let it slide. I had the same problem happen some dude tried to pull a chargeback on me..but he was saying I sent him a second hand phone so I offered a full refund if he returned the phone..and that shut his mouth...

Goodluck mate go down the route of the first option I am sure you will get somewhere even if they have sold the phone on.
