I won two disputes in similar circumstances? Took bloody ages but they gave in in the end

Absolutely. Somebody with a confirmed address could pull this stunt and win the dispute, but not if you use RMSD. Royal mail delivered the package to the buyers address which proves beyond all reasonable doubt that you sent it. You didn't get the money, end of. As I said, if the buyer didn't receive it then tough s**t, they should take it up with Royal Mail and the Police, it's not your fault.
The only real doubt could be that you and the buyer set up a dumb-arse scheme to scam Royal Mail for insurance money, which would be between you and the buyer and Royal Mail and nothing to do with Paypal at all.

i sent it via special delivery and provided everything and lost because it was sent to an unconfirmed address and the credit card used had been stolen.

They walked all over you. Even with all the warnings about unconfirmed addresses, legally they haven't got a leg to stand on if you can prove delivery.

Ie. what happens if the postman misread the address number or I wrote the wrong one? ( I'm not for one minute saying I Wrote the wrong one). But the fact that the buyers address was
"A4 "Fake Street""
The A4 bit is 100% real and the number I sent the phone to, I even got them to confirm this before hand.

Because legally, it's Royal Mail's responsibility to get the package to the address you wrote on it! That's what they charge you for, after all. Royal Mail will have a record of the address you sent it to. If you wrote the wrong address on the package then sure, that's your fault. It'll be up to you to contact the recipient and try to get the phone back. Good luck, sooner you than me!
But if the address was written correctly and Royal Mail delivered it to the wrong house, THEY are responsible, not you.
If what you say is the absolute truth (I'm not suggesting it isn't) then it's clear that the people who bought your phone are scammers, and not very good scammers at that. Get yourself down the CAB

in order to deliver the SD the postman HAS to get a signature (and, if i remember correctly) from someone residing at the addy... like, he's not supposed to leave it with a neighbour.
To send an SD u need the postcode... so u can easily google the addy to verify that the place exists...
...the unconfirmed addy thing is the little loop that paypal will squirm thru...
maybe once u have the delivery proof which u can hopefully get tomorrow, u could raise a dispute at ebay?

I agree. Which is why you CAN'T let them wriggle through that loophole. They only get away with it because very few people kick up a fuss. A letter from the CAB would be a big help, Ebay / Paypal hates potential bad publicity...
