You are not entitled to a refund if the phone is over a few weeks old.
Here is an extract from Consumer Direct (the government run website):
Your rights
If you have bought a mobile phone, it must be of satisfactory quality, fit for its purpose and as described.
When a mobile phone doesn’t meet some or all of these conditions, follow the advice below:
If you have only had the phone a few weeks or haven’t had a reasonable opportunity to check it, you are probably entitled to a refund for a fault or poor description, or alternatively you may request a replacement.
If the fault is only minor and can easily be put right, it is reasonable to accept a repair. This won’t stop you claiming a replacement or refund if the repair turns out to be unsatisfactory.
If you have had the phone longer than a few weeks or have had a reasonable opportunity to check it, you are probably still entitled to a repair or replacement. A repair should be carried out within a reasonable period of time and without causing you significant inconvenience. Any repair should restore it to a satisfactory condition. If this does not happen, you are entitled to a replacement or compensation. This could be a sum of money or the cost of having somebody else repair the phone.
If the phone cannot be replaced or repaired economically, you are entitled to a refund. The trader may make a reduction from the price you paid to allow for the use you have had from the phone.
If you are out of pocket in any other way, you may be entitled to compensation over and above the price of the phone.
The trader must sort out your problem, not the manufacturer
Remember, if you are entitled to a refund, replacement, repair or compensation, it is the trader who must sort out your problem. The trader cannot tell you to go back to the manufacturer or to claim through a guarantee or warranty.

How many people mis-read the bloody sale of good act? A Mobile phone is not a normal electronic product, it's not a TV or a toaster, a TV or toaster can be taken back to point of purchase within a year with POP and fully expect either a refund or replacement, a mobile phone doesn't fall under these rights...... I've worked for 2 networks and both polices are the same so can only assume it's similar across the whole retail experience (online is different due to European distance selling laws) but there are ways around that I will explain in a bit.....

The European distance laws say that if a phone is bought online it can be replaced if faulty within 6 months of purchase, now, as I said, should the place you buy it from allow you to take it back to store within 28 days if not liked etc they are exempt from having to offer you the 6 months
I apologise if this isn't the case in all retailers but this is how I've seen it rolled out across lots of stores
ALSO! Policies differ from store to store, don't take what I've said as read, always always ask about returns before buying the product, but as many people have said, I'd always stick to the network themselves........
As most of you know I used to work for Orange and currently now work for the UKs largest mobile phone retailer (per se)

Yeah, same. At the moment, our repair centre automatically replaces it if either it's been sent back to them three times, or it goes faulty with the same fault within 30 days of it being repaired.
Not finding faults, just explaining O2's policy compared to Orange's

Ahh yes, well supermarkets tend to be a little more flexible due to the huge turnover they've got they can throw at it lol.

T Mobile is the odd one. They offer no 14 day on pay as you go but you get 7 days return if you buy over the phone or online. Not in store.

Same goes for Three unfortunately.
If you buy any phone online or over the phone, I think they have to give you the right to return it, as it's distance selling and the regulations mention about being able to see the items your buying and choosing if you like it once you get it, due to not being able to see it at time of purchase.

I was listening to a show this morning online on Radio WM which is in Birmingham. I listen to this show alot its Ed Doolan and he helps people with consumer affairs. Anyway he had on his show this morning a woman from Trading Standards. Now she said there is no such thing as 28 day policy. She said that if something is wrong past a month if something breaks down you are still allowed an exchange by law. A guy called the show saying he had bought a mobile 30 days ago from CPW and it had died on him. The presenter got his assistant to ring the store to sort out an exchange. I found this all quite interesting.
