I agree, but what I was saying were, if we are challenging it now saying they should allow us to downgrade now then they could actually take a retaliatory action and ask us to pay £45 for the whole year since there is nothing in the contract against it.

Some sellers play a dangerous game, they will go ahead & let you downgrade say from £45 to £15, then they will send you a bill for the amount you WOULD have paid for the phone if you had bought it on a £15 a month contract.

I don't have the paper work right with me, since I am at work now, but I am quite sure on the document I signed, which has the Terms and conditions on the back, it is mentioned on the top right hand side 'On £45, 400 minute x network contract, 400 text messages etc.

If your contract don't have it then there is a chance that they changed the contract recently (may be they came to know about this scam) since I took the contract on the saturday the 6th and they printed the contract from their website. So their is a good chance it may have been updated very recently.

PS:Don't think I am against complaining to oftel, I am more than happy to send a letter. I think if we talk about this we will be more prepared

PPS: Could any one confirm after looking on the contract whether the tariff is written there or is it only on mine

It does not mention anything about changing contracts!! so what if they dont let us change at all ....then i think we are all f-`*ed!!!!

Just a note about verbal contracts. Under Scottish law a verbal contract between two people that is shook upon and witnessed by a third party is legally binding. The same does not apply under English law, which is the law used by the networks.

P.S. It is also Scots law that one must allow someone to use one's lavatory if so requested, even if the person is a complete stranger. Not very enforceable I would imagine.

Now then lads, thanks to all you lot I have a P900 from O2 for free (on £45 per tariff). So kudos to you all.
However, the 'boy' in the shop told me that data calls are included in the 400 minutes that are included in this tariff. He didn't really understand it and took my email address to forward me the details (nothing yet!)I subsequently find that what he told me is not the case and that GPRS is free from the handset until end of Jan 2004. And then one of the GPRS tariff bundles will have to be subscribed to. Is this true? Anybody know the real story?
When I rang O2 Customer Service I was told that I could go into the shop at the time the free service ends and "look if they've got a suitable tariff" for me.
What do you make of that?

@Bshface, your being fobbed off. the boy will probably deny saying it, but you could send the phone back, stop paying the contract on the grounds you were misinformed.

Only 02 WAP GPRS is free until Januvary 30th and the Data GPRS service of 02 called MobileWeb is not free.
