They know because the Operator does not pay the link Billing Commission for the sale. They know about it but they dont do anything about it in the way of clawing back. I guess they figure that they do enough overall connections not to have to worry about it.
Oh and Orange arent the only network that allows you to downgrade tariff straight away, vodafone let you do it to depending on what service provider you are with.
