If you do record his calls makes sure at the start of the call you are heard saying the call is being recorded other wise you can be done for entrapment an you'll get prosecuted and not him

calls are not recorded, only time and date info is available if not being monitored actively.
text messages are viewable for a certain period of time even if not being actively monitored
