With regards to the phone itself, the Sale of Goods Act 2002 European Directive which applies if you bought the phone from a Vodaphone shop: http://www.dti.gov.uk/ccp/topics1/saleandsupply.htm#directive
states that if you simply change your mind about wanting the goods, there is no legal remedy. However Vodaphone themselves say they will change a phone regardless of this, as far as I am aware, so you should be ok on that. Most places will just take a phone back for good customer relations. I took a Samsung E600 back to Carphone Warehouse [it was sim-free, no contract] simply because I didn't like it and it didn't do what I wanted, and they gave me my money back no problems at all.

The Distance Selling Regulations when buying goods over the internet are here:
http://www.oft.gov.uk/Busines[....]stance+Selling+Regulations.htm

I am still searching for the legal standpoint on the Vodaphone contract itself. You can tell I work for a lawyer can't you! Do you have a copy of the Vodaphone contract that you signed? Does ANYONE have a copy of the Vodaphone contract that you sign in a shop [not over the internet] - this should tell you your rights to cancellation of the contract itself. I'm sure there are people who have managed to cancel their contracts within a certain number of days - although I'm not sure it's as long as 14 days?

Just as an aside to this post whilst I think of it, be very very careful if you order a sim-free mobile from http://www.mobiles.co.uk. They will not give you your money back if you return it to them if it isn't faulty - in spite of that being in direct contravention of the Distance Selling Regulations. Read their Terms & Conditions very carefully before you order from them. It took me a long while of legal wrangling to get my money back on a returned sim-free phone a few months ago so be warned! I reported them to the Office of Fair Trading, but whether anything has yet been done about it, I don't know.

www.mobilefun.co.uk have always been excellent with me. They've taken goods back when necessary, given prompt refunds, been very helpful when I've rung them up about something. Good prompt attention to sending out orders too.

o2 o2 o2!

orange have pluses and minuses, but the only thing that i think is a major plus with orange is the flexibility and the coverage. They have a lot more mobile phone masts. But o2 dont personalise their phones, and have the cheapest price plans and even in some stores (like the one in newcastle), have a there-and-then mobile repair centre!

I had a bad experience with mobilefun. I ordered a s700 on Thurstay. To be delivered to my place of work next day(£5extra) Thursday evening I received an e.mail telling me that it was out of stock, but they were expecting more stock next week, and would send it then. On Friday I noticed their web site said that they were in stock. I phoned Friday afternoon and was told that it was being sent out to me as we spoke. Monday delivery was gauranteed but maybe I would receive it on Saturday. 2pm Monday I phoned to enquire about the progress and was told that it had actually been sent out to me on Thursday! 4pm Monday I got a call from THEM saying that as the delivery address was different to my credit card address they needed to see some proof of my address before they could send it!!!
I cancelled it.
