The last time I bought a phone that was not sealed was the Nokia 8890 almost 3 and a half years ago!

Hmmmm . . . I guess I'll go for the one which has been used 'slightly' for demos, as it has been already warmed-up (done some exercisin') ! Compared to the 'sleeping' one as it may not just wake-up after all (defective units) !

Of my last 2 phones, both orange branded, one from an orange shop and one from an independent chain, both where in sealed boxes, and both times the shop assistant opened the boxes IN FRONT of me to check the contents where complete (orange often forget 2 put the sim cards in) when i bought them. There would be no reason to break the seals and openn them b4 they where actually sold, and i would ask for a different one.

@danielwong
None of the boxes are sealed, just the plastic packaging that the phone itself is in, should have a littel

logo sticker on it.
The boxes aren't sealed by

(Network-locked versions e.g. Orange, Voda Live may be different, as these are boxed by the networks).

Well mine was an unbraded one from CPW. The box didn't have any tape seal across the flap like my P900 on Orange did but all the contents were in sealed plastic bags with the P910i in a bag taht had a round SE sticker seal.

My box had an outer seal, a little tag with a hologram on it. Any phone i've had, has had this tag, regardless of manufacture or network.

Mine was sealed from the manufacturer.
With a master reset the setup wizard can be reinitiated.
