S700 too has the problem. But not the p series.

I came across your post pretty much by chance. Ive had the same problem with o2. They didnt offer me the same phones (infact they offered worse phones). None of the phones were acceptable. Im glad to inform you that they ARE cancelling peoples contracts. I have had mine cancelled AND have kept the phone (Im awaiting Orange to activate my number port then my final bill will be issued by o2). A friend has his terminated the day he phoned and terminated his contract- without a termination fee. Others have had to send their phone back. All in all, its o2's fault. They have supplied you with a handset that is not compatible with their network. They cannot replace it with a suitable alternative (to you). As such (IMO) they have broken their side of their contract with you. I suggest you read this thread- most of the relevant posts are near the end IIRC. If you need any further help let me know, and ill help you if I can.

thanks for your reply it was most interesting and useful. The latest I can get from O2 is that they will give me an S700 for free if I sign another 12 month contract or for £40 to stay with my remaining contract (6 months left). Both are unacceptable to me and they are still refusing to cancel my contract. I will wait a while and then push them to cancel. I don't see why I should pay or extend my contract for their mistake. I can't afford to be without my mobile at the moment (my number anyway) so I'll hang on because it sounds like they will faff around porting my number. Thanks again for the post.
