Nope, because it was a T-Mobile upgrade. If I could get a refund I would. Then I'd wait a month or so and then upgrade!

Is there a chance I will get an even worse built one if i go to the same store?

mine was an upgrade to with Orange but via CPW.

You should be able to get a cancelation of the new contract signed for the upgrade unless they can offer you a phone you want in its place.

I will go for this and then upgrade when the N82 is in stock.

Don't forget, upgrade or not - sale of goods act and fit for purpose. This phone does not work currently. 3 phones all exhibiting different faults and build issues.

Its a shame, all my previous SE phones have worked nearly flawlessly. I love SE phones. But they have lost the plot on this one and I have signed a contract to pay Orange a monthly fee to cover the air time and phone cost.

The K850 cost me nothing up front - a free upgrade. But I will not live with it for a year in its current state. I cannot afford to wait for FW updates as i use the phone for business and after spending 7 hours in the car today and being unable to speak to customers - loses me business.

Just collected my 4th K850. Speaker grill is not glued down correctly, so far refuses to receive SMS's.

syncing with Mac works Ok

Still testing.

Mine seems to be perfect compared to some of the horror stories on here however there is definitely many quality control issues with some.

Plank... lucky for you and your mates... really I am so glad your happy with your K850.

Just to add to what I wrote below :

Bluetooth audio still crackles and repeats. Seems its 037 causing this as 029 worked great in this respect - just in others it was rubbish.

So, as I spend lots of time in the car on handsfree, this phone looks like it will be useless - good cam or not. Unless there's an update that fixes the phone before mid next week, its back it goes and I move brands to something that I know from others reports will work.

sigh... SE have lost it on this one and will loose a loyal customer.

I am going to take mine back as the loose battery cover is annoying me....it creaks and moves when i press the * button on the keypad....hopefully(touch wood) i'll get a decent replacement
