Dare I ask why you are even telling them that you are using a non-orange handset, and thus breaching the terms of contract? (you've signed to say that you will ONLY use Orange supplied equipment with your SIM card).
They can of course check to see what IMEI you are using, but they won't really bother. How about you just say that you are still using a T68i or whatever handset you do have on Orange? It'll make no difference.
Lastly, the SIM-free handset is not the issue. Either MMS is NOT enabled on your account, you have NOT set it up correctly, or the Orange MMS service is not working at the present time. There's no other explanation, so find some who does have Orange MMS working on their handset, check EVERY setting on yours to make sure it is correct, then phone Orange. Don't even mention what handset you are using, just ask for them to enable MMS on your account. If it already is then ask them to remove it and re-provision it. Finally, ask them if they are having MMS service troubles. Got to be one of the three.

All providers have contracts/terms and conditions which state that during your 12 month contract you are only allowed to use your orange sim card in the phone provided to you buy Orange.

It sounds like the problem I had. Is the phone you are contractually signed to MMS compatible? If not, then they'll need to enable MMS on your account and send you a SIM update to enable the service. I am contracted to a Sony Z7 and never used it. I use my SIM-free T68i. I called and they said my phone wasn't compatible so I just said my company had given me an Orange mobile and I wanted to use my SIM in it however all the services don't seem to be working. The lady hesitated a bit so I asked her to speak to her team leader and call me back if there were any problems. A few SIM updates later, MMS works and so does GPRS. I found this argument cancels their argument that I wasn't using a "compatible" handset.

If they haven't released the phone they have not yet put in place the diagnostic's and all of the other support structure to handle queries about problems with this phone.

Well as Simion said - just tell them you have a t68i - the settings are no doubt identical in terms of what they would send to the phone anyway. Orange are just a bit finnickey when it comes to what they will and won't support - at least if you are using an Orange branded product then they can expect their CS to have a reasonably good idea of how to support a phone and have a few known issues (and hopefully solutions!) at hand to help you.
Orange's terms and conditions actually state that, as a customer, you will: "use only Phones and Accessories approved for use with the Network, and comply with all relevant legislation or regulation relating to their use" which basically means that as long as it is GSM/PCM compatible you should be fine - but just don't expect them to offer any real support unless the particular model is officially available on Orange. This does not mean that you can only use Orange branded products although I'm sure there will be some OCS agents who will misinterpret that (or been given duff information by their supervisors). As always with cust serv use the rule of three: phone them up three times and take the average of the different answers you will no doubt get
Sometimes it is easier to be economical with the truth when speaking to OCS - they have strict rules as to what they can and can't do and can be very difficult to deal with if they think you are asking them to do something "they aren't supposed to". If you just stick to the bare minimum of facts that you think they will need to know to get your problem fixed then you have a better chance of getting a useful result - the more information you give them, the more likely they will find something in that information that prevents them from helping you! Basically give them information on a "need-to-know" basis only.
As Simion has already pointed out there really shouldn't be any reason for your MMS not to be working if it is already activated on your account. I would double check the settings both in your MMS options (what WAP profile is it trying to connect to) and the settings of the WAP profile itself. Maybe if you posted some of these settings here we may be able to spot the problem?

I work 150 152 & 156 so i know loads:-D the t610 is on our configurator even though it is not released yet - u can use a sim free phone no probs-its just not covered by care - they cant help much yet as the handset has not been relased-but ring again you can have mms

There may be some issues with the Orange MMSC, which could prevent you from using the Orange MMS service.

Well nobody wants to accept my posts as correct but please accept @orangman as he does work for Orange.
As i said earlier i got all the Wap, web, MMS, GPRS settings sent to my p800 from Orange MONTHS before they offered that phone, some people cant work it out, you dont lumber a customer services team with questions about your handset if it wasnt supplied by them, but they are happy to help you with anything to do with your sim & anything that involves spending money with them.
Remember thaat you may have BROKEN the phone you bought on contract with them & have bought yourself a new one.
