I think you can cancel the contract only after MAY 1st though because until they change the rate there is no breach of contract. So in short you have to wait until they make a breach.

Then I think people can raise the issue of the increase in the rate or rather the charging of wap GPRS (this was free and they are going to charge from May 1st) which every one was using a lot. Cant we?

Chances are that O2 will tow the line of this only applying to the mobile tariff price change rather than actual call charges if you call the customer services team. (Not sure but most contracts have a section on the being able to raise charges and give you 30 days notice).
Best bet if you're desperate to leave O2 would be to write in to their managing directors team or complaints dept and quote the part of contract and legal arguments, ie. back them into a legal corner and a threat of legal action wouldn't go amiss either...

Again, the wording of the contract is crystal clear: elements of the service you are using. There's no way that can be constructed to refer *only* to the basic tariff. As an analogy, if they raised the cost of an SMS bolt-on, that would also fall under 8.4(c).
The May 1 change in GPRS charges, however, is almost certainly not grounds for cancellation. They haven't technically changed the rates for GPRS, they're merely ending what was a limited time promotional offer.
And as I have already mentioned, *I've done this*. It works. Stand up for your legal rights, you've got them in writing, and don't back down.

Why do some people on this board seem so committed to getting a free P900 or P800 without a contract. And then wanting to cancel contracts. For us people that actually use our phones and GPRS rather than posing never seem to get the same deals.
Cracked software, free phones on a £15 contract, what next!

tried it with o2, "apparently their legal team" have looked in2 this, and it only applies 2 the tarrif, which is complete lies, in goin 2 consumer link, and watchdog k over this, i advise u all 2 do the same, so we can get some momentum on this, lets get 1 over on o2
