hi everyone!
i have been avictim of eBay too!
but this time i was the Seller!
i sold my 2months old T610 boxed with loads of accessories... as i had bought my current P900 on contract!
it was sold for nearly £200 by a guy in London with zero rating!!!
anyway, he payed through PayPal, and once i saw my Paypal balance, i withdrew the money and sent the phone in less than 24 hours through 1st class recorded delivery!
6 or 7 days later, the guy claimed his money back from paypal saying that he hasnt recieved the item!!!
Paypal sent me an "urgent email" stating that i have to either pay the the money bakc or provide the with loads of details and a proof of me sending the item so they could investigate and resolve the issue!!!
within the next two months i sent all the info they asked for 6 f**king times, and all they did was, sending me the same email in response saying they need info or the money from me!!!
i also tried phoning the Paypal people, but never managed to speak to a real person!!!
Result: at the end i had to pay the £200 back to Paypal, and my almost brand new phone was gone......
here is the email Paypal sent me and then my reponse:

I sould NOT be liable for that money as i have already posted the item.

i have posted the item off to the buyer on 05/01/04 via Royal Mail Recorded delivery service with the tracking number of DT318310329GB and it has been delivered on 06/01/04 before 10:37am.
therefore, I request the money back which you have reduced from my PayPal balance. i have also sent an email to the buyer but have NOT recieved any response.
PLEASE deal with this matter as quickly as possible as i am a student and need the money.

....I really feel for you mate!..ebay and paypal are just turning into more of a gamble nowadays! ..I think its about time there was a watchdog and a regulator for sites such as ebay and other auction sites...zyavar my only advice to you on this would be to first file a complaint against ebay and paypal at your local trading standards office..and then go to the media...Papers,radio,tv...the more publicity the better...the only way ebay will stand-up and do something about these kind of scams is when they get lots of negative publicity!

I agree that Ebay is a softspot for people willingb to act fraudulently. However if you play it safe you cant lose.
I for one, never bid or sell items unless the other party accepts bank transfer. That way i have his account number and if anything goes wrong the money is traceable. The person cannot disappear.
Secondly i would only bid/sell to a member with low rating if he is new and accepts bank transfer to a UK account.
I only use Ebay UK to make it even safer, and never bid/sell overseas

Also just a question, if someone pays my PayPal account and it goes into it, then I am in the process of it being transferred to my bank account that money is safe and cannot be retracted or anything right?

I am terribly sorry to say this, but in my opinion you should not have transferred the £200 back to paypal. Since the purchaser claims to have not received the phone, you should have contacted Royal Mail (you stated that the phone had been sent by recorded delivery). They should have a record of the signature provided upon delivery. If this signature cannot be matched with the buyer, Royal Mail has a problem, as they have not delivered the package to the correct receiver.
If the Royal Mail avenue had not proved fruitful, you should have pursued Paypal. You state that: "i also tried phoning the Paypal people, but never managed to speak to a real person!!! ". There is consumer protection legislation in place (in the UK) which attempts to combat companies exercising policies which have an onerous effect upon consumers (Unfair Contract Terms Act). In particular through unclear or vague contract terms, and business practices which attempt to discourage customers from reasonable ways of communicating with the company ( these implied terms are not limited to the Unfair Contract Terms Act, and extend to, but are not limited to any relevant precedent, and/or any superseeding legislative measures.) . I presume that Paypal is a global company, however if it has any operations in this country you should be able to track down a trading address. E.g. Any Private Limited company must display their trading address in a prominent place (eg on their letterhead(Companies Act)).
I would really like to give you specific legal advice right here on this forum, however I don't feel comfortable doing so in this litigious age. On balance, I would advise you (as an opinion expressed outside my professionel capacity, and completely in a NON legal way) to take all evidentiary material (i.e. any emails you have from or to the purchaser, any details of address etc pretty much anything which relates to the sale of your t610). to your local Trading Standards Office, and lodge a complaint against Paypal, and potentially Royal Mail depending on their competence/incompetence in the matter. Trading Standards are usually very good in following up on complaints. Just remember to not accept no for an answer.
