THIS IS OBVIOUSLY A SCAM!

My brother in law is a postman and has been for five years. My sister works in the post office. A postman would not be daft enough to admit to the person that didn't receive the mail that they themselves signed for it! They have to go back to the sorting office at the end of their shift (and sometimes during) anyway, it's no problem to take a light package back with them. They have nothing to gain by forging a signature and dumping it, especially if its RMSD since it's so obviously and accurately traceable.

He's trying to scare you! don't let him! The guy is clearly as thick as two short planks and when you put your complaint in to Ebay (you are going to do that aren't you?) they will see exactly what's going on, just like we can. If they don't, a letter from the CAB will certainly make things clearer for them.

Just persevere and try not to let it get to you. The buyer's story is about as convincing as George Bush converting to Islam, it'd be hilarious if it wasn't so serious!

mais non sammy boy.. RMSD (Royal Mail Special Delivery) is a lot lot different from RD (Recorded Delivery)....

take for example..

I had a RMSD parcel turn up at my house on saturday for the previous owner, because I said I wasn't him, the postman said ok cheers and toddled off with the parcel for the old owner of my house...

there is no way on gods green earth a RMSD parcel has been taken by a postal worker, it's like working at a bank and stealing one solitary 1p... really really really not worth it..

This is why a little bit of legal advice could come in handy here. Paypal could try and wriggle out of it by saying that the seller should put a claim in to RM and recover the cost through insurance, just like the buyer has suggested.

But in a court of law, the proof of delivery and the fairy stories from the buyer clearly suggest that a scam has been going on. I'm not suggesting that something like this would or should ever go to court, but that's where the situation now stands in my view.

I know I keep going on about it but it's amazing what well-worded letter from the right people can do. The point is that even if you could claim your money back from RM (I don't think you could since a signature was obtained) then this scumbag buyer will have deceptively obtained a free phone. Cyco doesn't like things like that!

I was talking to my works postman who collects the post and he told me never send anything of value via Recorded Delivery only ever use RMSD as if an RMSD goes missing the sorting office hit the roof . Its highly unlikely that the postie signed for and stole/dump the package.

As many have said it deffo a scam, don’t let this loser get away with it!

well thats your proof just let PayPal sort it out now!

I once learn't a big mistake myself by asking someone at work to post a phone (Siemens S65).. I told them Recorded Delivery..

next thing I knew the Buyer (Also a eBuyer) told me he hadn't recieved it this went on for a week or 2, the buyer told me he had moved out of the address but he still had access to it.

he told me he hadn't recieved the phone I asked the guy at work for the reciept then he told me he bloomin well lost it, I was in the pickle a while had to refund the buyers money but I was so annoyed with the person at work that he gave me the £50 for it phewww!

Thing ive learn't is if you want anything doing do it yourself

I also had a idiotic buyer for my iPod mini..
I sent it he breaks it and complains to PayPal,
PayPal won my case and I should think so 2....

the person plugged some other iPod charger in it and broke it!
he was pissed I think cos I waited for his money to clear before I sent it out he would get pretty funny throughout 2.

as you can see, there isnt actually a signature, so anyone could have printed that name. But surely this is enough to say it was actually delivered?
