I'm in charge of a lethal weapon as I clean my house with bleach but that doesn't deem banning...
IMO the government has gone one stop too far, for smokers, smoking while driving is second nature, just like me changing my cd while driving, but I feel the opacity of the law isn't good either, it is going to enable Police personnel who don't agree with smoking the ability to pull over anybody they see smoking and do them for without due care and attention as no proof is needed whatsoever for a FPN....
I'm not even a smoker but that can see the flaws in this.....

That doesnt beat the woman i saw a few months back getting out of her car at a petrol pump with a cigarette in one hand and talking on a phone with the other.
Smoking while driving can, but not always, impear a persons driving.
This is by no means that worst thing that can be done while driving and the fine is just plain stupid. I am waiting for the government to introduce no smoking cameras on our roads.

No its the Person! it doesnt matter if she has a banana up her nose when driving if you hit someone its purely down to the driver and them being a bad driver!
as for the person at a station with a fag n fone, well its not the ciggies fault for lighting itself up and jumping in her hand!!!

well a good driver drives in a manner that they are prepared at all times for all eventualities.
but you put it well, and you didnt mention the fact that they have to be smoking at the time too? do you see my point?

@ Fatreg: unless u r planning to pour the bleach over someone, i don't think u can compare a car to a bottle of cleaning fluid...

ok a gun? when does it become dangerous? while the pope is holding it or a terrorist is?
same applies a lot through life, its only dangerous if the person is, or makes it dangerous.

yeah, but the way some ppl drive they might as well be holding a fully loaded gun!
i live out in the sticks... ido a lot of running and some of that ends up on country roads. i tell u i see it all: smoking, chatting on mobiles, eating and worst of all map-reading. i'm now quite adept at leaping into the ditch when the driver of the approaching vehicle is apparently not concentrating on their driving cos they're busy with sg else!

exactly, but its not the fact that someone is smoking that means they are going to take you out while your running! it doesnt take anything to distract someone.
daydream? ban those then and fine people for daydreaming while driving. loadsa people do it?! especially when on the local regular route.....

In reality, nothing has changed because previously, as now, if you caused an accident due to doing something where you attention was taken away from driving, you could be prosecuted
here is the wording in the new Highway Code (rule 148)
148
Safe driving and riding needs concentration.
Avoid distractions when driving or riding such as
loud music (this may mask other sounds)
trying to read maps
inserting a cassette or CD or tuning a radio
arguing with your passengers or other road users
eating and drinking
smoking
nowhere does it say smoking is or will be banned and if you can smoke while still maintaining 100% attention to the control of your car then there will be no problem
of course, if the police see you driving without "due care or attention" and you happen to be lighting up at the time, perhaps looking down at the cigarette lighter or whatever, then they will pull you over for that "lack of due care and attention". Even then, you will not get points or ban for smoking specifically... it will be for lack of "due care and attention" just as it would if you were changing channels on the radio or trying to read a map
