hmm, hasnt said anything since this, and phone hasnt come, been 2 days, guess hes waiting till it clears...I want to message him asking if hes made his decision yet but my mum ses he may be busy and i dont want to pester him too much
do you guys think i should essage him or not :S

I would just drop him a line. At least then, you will know you have to wait a few more days. Just hope he's not stalling for any other reason.
Be polite but factual ie "Hi again, have you made a decision yet on whether this can be posted? As I said yesterday, I was under the impression from Paypal that by getting my address confirmed with a verified account that any money paid to you was quite safe. Thanks."

He aint got his N95 yet as the seller is waiting for payment to clear from paypal into his bank account

yer but the trade is insured so if he does do that and i do win the dispute it will give me the money and bring his into minuses
if not like i say im insured up to £150 or soemthing, then theres always police.
Oh and i did reply to him and said:
"Hi, just wondering if you've had time to mae a decision or not yet? If not is your paypal any closer to clearing..."
