No Orange do not OVP any '3' tariffs.

As a retention tool, they *may* match the '3' tariff price to stop you leaving, but it depends on your average monthly spend.

@Geezer041 - the '3' talkplans are not matched such as other ovp tariffs, but as stated are retention talkplans.

750 xnet minutes for £35 a month - bargain.

Is it true what I've heard about '3' tariff free minutes can only be used when in 3G coverage? As soon as you connect to GSM you get charged standard rates?

If so it makes Orange's deal look even better.

It's a manufacturer's guarantee, but it's up to whoever sold it to you to deal with the manufacturer - you should not have to deal with the manufacturer yourself.

If Orange sell me a handset, I deal solely with them.

@Orangeman, fair enough, but people who buy from dealers need to go back to the dealer, not the manufacturer.

If I buy a handset from Orange, and it develops a fault in month 7, Orange cannot demand £15 for a replacement. They might be able to ask for £15 for a next day exchange service however, and offer the option of me sending it back by recorded delivery in a jiffy bag at no extra cost.

This £15 charge is what the topic is about after all.

Part 5A, Section 48A, Sub-section 3:

I don't study contractual or civil law - so if anyone can point out a mistake I would appreciate it. But the way I see it, a multi-billion pound company has people trained to interpret UK legislation a great deal better than I can/

Thanks for that - although in my understanding (I don't study law either) this bit is talking about whether the goods 'conform' to what was ordered in the first place.

I think this is a new right, in addition to all of the old stuff, and it looks like consumers have 6 months to tell the seller about (e.g.) shortages.

This is an interesting article which explains the latest rights.

The 4th section concerns what you mention, and interestingly, under section 5 of "remedies" it says the seller must pay any costs involved in repairing/replacing the goods, including postage/packing. This means that Orange should not charge the £15.

Just looked in to it further... this is all about something called the "Reversal of Burden of Proof".

Before this additional right, it was down to the consumer to prove that the goods were not damaged by him/her. Now, for the first 6 months, the seller must prove that it was down to the consumer - if they beleive so.

It is interesting, as it kind of introduces a bit of doubt over what happens after 6 months, but it's an additional right, the goods must still conform to the other rights.
